국제 항의 편지 [번역]

한미 FTA 저지 범국민운동본부의 오종렬대표와 정광훈 대표의 구속을 항의하면서
두 대표를 즉각 석방하라! 한미FTA 저지 범국민 운동본부의 탄압을 즉각 중단하라!
대한민국 대통령 노무현께,
우리는 한미FTA 저지 범국민 운동본부에 가해지고 있는 탄압과 두 대표의 구속에 대해서 심각하게 실망하고 걱정하고 있다. 이 편지는 범국본의 오종렬 대표와 정광훈 대표의 즉각적 석방과 범국본에 대한 탄압을 즉각적으로 중단할 것을 요구하기 위한 것이다.
첫째, 오종렬 대표와 정광훈 대표의 구속은 가장 기본적인 민주주의 원칙과 헌법상의 권리를 직접적으로 침해하는 것이다. 우리는 대한민국이 헌법 질서하에서 집회의 권리를 보장하고 불공정한 법적 집행을 반대하는 민주주의 국가라고 믿는다. 이러한 권리는 모든 민주주의적인 국가에게는 기본적인 것이다. 우리는 두 분의 구속이 민주주의 국가로서의 대한민국의 지위가 후퇴하고 있는 것을 나타낸다고 생각한다. 더구나 두 분의 나이와 건강조건을 고려하지 않은 이번 구속은 경찰의 비인간적인 모습을 보여주는 것이다.
둘째, 두분의 구속은 정치적. 시민적 권리에 관한 국제원칙을 침해하는 것이다. 유엔의 회원국으로서 대한민국은 사회적 자유와 인권의 진보를 촉진하고 보호하기 위한 국제협정에 조인해왔다. 대한민국은 1970년대 이후에 중요한 정치적 진보를 이루어왔으며, 우리는 이러한 변화를 목격해왔다. 우리는 민주적인 수단에 의해서 선출된 노무현 정부가 한국의 역사를 잊지 않고, 국제적. 민주적 원칙을 장려하길 촉구한다. 국민들의 집회의 권리와 그들의 의사를 표현할 권리는 반드시 보호되어야 한다.
그리고 세 번째, 우리는 즉각적으로 범국본에 대한 경찰의 억압을 중단할 것을 요구한다. 우리는 대한민국의 헌법(21조)가 집회에 대한 허가제도를 인정하지 않고, 단지 신고제가 필요하다는 것을 알고 있다. 또한 범국본이 항상 집회를 사전에 신고했음을 알고 있다. 그렇기 때문에 우리는 범국본의 활동은 결코 불법이 아니라고 믿는다. 언론에서 보여지는 FTA 항의에 대한 탄압은 놀라운 것이다. 범국본의 활동들이 별도로 가려줘서 불법으로 결정되는 것은 대중적인 조직에 대한 직접적인 탄압과 대한민국 헌법의 명백한 위반임을 나타내는 것이다.
우리는 범국본의 활동과 두 대표에 대한 노무현 정부의 결정을 인정할 수 없다. 우리는 한국 자동차 노동자의 최근의 억압과 함께, 범국본 탄압이 한국 민주주의의 위험한 이탈의 경향을 나타내는 신호탄이라고 생각한다. 만약 이러한 경향이 계속된다면, 국제사회는 더 이상 좌시하지 않을 것임을 분명히 한다. 그리고 우리는 노무현정부가 이러한 오류를 시정하고 한국과 전세계의 민중에게 고유한 권리를 복구시킬 것을 강력히 요구한다.
